Terms of Service

By using AlphaSutra ("the Service"), you agree to the following terms. If you do not agree, do not use the Service.

1. Service Description

AlphaSutra is a platform providing two services:

• Options Trading: An AI-powered BankNifty options trading assistant that provides market analysis, trading signals, and automated order execution via Zerodha Kite Connect.
• CA/Tax Filing: A workflow tool for Chartered Accountants to manage client documents, auto-extract financial data, generate tax computations, and track filing status.

Both services are accessible through a web dashboard and WhatsApp.

2. Eligibility

• You must be 18 years or older.
• You must be a resident of India with a valid Indian phone number (+91).
• Traders must have a valid Zerodha trading account for trade execution features.
• CAs using the tax filing service represent that they are qualified to provide tax advisory or filing services to their clients.

3. Trading Risk Disclaimer

Trading in futures and options involves substantial risk of loss and is not suitable for all investors.

• AlphaSutra provides AI-generated signals, not financial advice. All trading decisions are yours.
• Past performance of AI models does not guarantee future results.
• You may lose more than your initial investment. Only trade with capital you can afford to lose.
• We are not SEBI-registered investment advisors or portfolio managers.
• The automated execution feature places real orders on your Kite account. You are solely responsible for all trades executed.

4. CA/Tax Filing Disclaimer

• AlphaSutra automates document processing and data extraction. Extracted data may contain errors and must be reviewed by the CA before filing.
• Tax computations generated by the platform are estimates based on extracted data. The CA is solely responsible for verifying accuracy before filing with tax authorities.
• We are not a tax advisory service. The platform is a tool to assist CAs in their professional workflow.
• CAs are responsible for obtaining appropriate consent from their clients before uploading personal data and documents to the platform.
• Document upload links sent to clients are the CA's responsibility. Ensure clients understand what data is being collected and how it will be used.

5. Your Responsibilities

All users:

• Keep your account credentials secure. Do not share them with anyone.
• Report any unauthorized activity on your account immediately.

Traders:

• Keep your Kite API credentials secure.
• Review and verify all signals before execution if using manual mode.
• Monitor your positions and ensure adequate margin in your trading account.
• Authenticate with Kite daily if you want auto-execution to work.

CAs:

• Ensure client data entered on the platform is accurate.
• Review all auto-extracted data before using it for tax filings.
• Obtain client consent before uploading their documents and personal information.
• Do not upload documents containing data you are not authorized to process.

6. CA Client Upload Links

Upload links generated for CA clients are token-based and expire after 30 days. Clients do not need to create an account. By sharing an upload link, the CA represents that the client has consented to the collection and processing of the uploaded documents. AlphaSutra is not responsible for unauthorized use of upload links.

7. Service Availability

The trading service operates during NSE trading hours (9:15 AM - 3:30 PM IST, Monday-Friday). The CA/Tax service is available 24/7. Either service may be unavailable during maintenance or due to technical issues. We do not guarantee uptime or uninterrupted access.

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any trading losses, missed signals, failed order execution, or system downtime.
• We are not liable for errors in AI-generated signals, extracted data, or tax computations.
• We are not liable for losses due to Zerodha/Kite API downtime or exchange issues.
• We are not liable for incorrect tax filings resulting from errors in auto-extracted data that were not reviewed by the CA.
• Our total liability shall not exceed the fees paid by you in the preceding 12 months.

9. Intellectual Property

The AlphaSutra platform, AI models, document processing pipelines, and associated content are proprietary. You may not copy, reverse-engineer, or redistribute any part of the service.

10. Account Termination

We may suspend or terminate your account at any time for violation of these terms, misuse of the platform, or at our discretion. You may delete your account at any time via the Data Deletion page.

11. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

12. Changes

We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the revised terms.
